Ohio’s highest court upheld a 2006 state law that prohibits cities from imposing residency requirements on their employees.
The Ohio Supreme Court ruled that the state law striking down residency requirements did not violate the “home rule" provision of the Ohio Constitution which lets cities pass local laws.
“We have watched this case closely as it worked its way through the legal system,” said Ohio Council 8 General Counsel Sean Grayson. “With this decision the Ohio Supreme Court has settled the matter.”
According to Grayson, Council 8's focus is on negotiating strong contracts and representing its members on the job. The union has responded to members’ concerns at the bargaining table by making sure our contracts include reasonable and fair treatment where residency requirements exist.
This decision is one more round in the tug-of-war between local government control and the state legislature.
